Terms & Conditions

Please carefully read and understand the following agreement which will apply to all bookings. All contracts and transactions between Framed Media and the client whether made verbally or in writing, are subject to these terms and conditions.

SCOPE OF WORK

Framed Media will provide the services outlined in the agreed package, whether confirmed verbally or in writing, which may include:

Real Estate photography and videography at the requested address
Additional services such as drone work, lifestyle shots and floor plans
Post-production editing of photographs and videos

Although Framed Media will make every effort to produce all requested media, no particular composition or shots will be guaranteed.

The media produced by Framed Media is protected by Australian Copyright Law. The Client acknowledges that Framed Media retains full ownership of all media sent to the Client.
Framed Media retains the right to use any media for portfolio or advertising purposes.

Usage

Upon full payment, you will be granted a license to use the photographs and videos for marketing and promotional purposes related to the property. All delivered media, however, remain the intellectual property of Frame and Focal.

Third-Party Usage

You are not permitted to sell, license, or transfer the photographs, video or any delivered media to any third party without obtaining our written consent.

Restrictions

You are not permitted to modify or edit the photographs, video or any delivered media in any manner without our prior consent.

BILLING

Fees

The fees associated with any service will be outlined to the Client prior to the shoot date and is inclusive of the selected package and any additional services which are incurred.
All services provided by Frame and Focal are subject to GST and will be outlined within the Client invoice.

Payment Terms

An invoice for direct payment will be issued upon completion of the shoot, with payment due within 14 days from the invoice date.

Cancellation/Rescheduling

If the Client cancels or reschedules the booking within 24 hours of the scheduled shoot, a cancellation/rescheduling fee may apply. The fee will be discretionary and based on the circumstances, up to 50% of the total fee.

DELIVERY

The final edited photographs and videos will be delivered in a high-resolutional digital format suitable for web and social media use.
We guarantee edited photographs to be delivered within 24 hours of the shoot and average 48 hours for video turnaround.
Please note, Framed Media does not release RAW files.

CLIENTS RESPONSIBILITIES

The client ensures that the property is accessible and prepared for the shoot including any staging or cleaning.
Any special requests (specific angles, props, models) must be communicated in advance to the shoot

DIGITAL MEDIA

Framed Media are not obligated to store any media after 7 days once it has been received and deemed satisfactory by the Client.
Any archiving of media beyond this period is at the sole discretion of Frame and Focal.
If any media (photos, videos, etc.) do not meet the agreed-upon standards, please notify us within 48 hours of receipt.

LIABILITY

While we take all reasonable precautions to prevent damage during the shoot, we are not liable for any property damage that may occur.

Our liability is strictly limited to the fees paid for the services provided. We are not liable for any indirect, incidental, or consequential damages.

AGREEMENT ACKNOWLEDGEMENT

By booking a shoot with Framed Media, the Client confirms that they have read, understood, and agreed to these terms and conditions. In the event of a breach, Frame and Focal reserves the right to terminate the contract immediately.
